Nagpur, India: On Monday, the Sessions Court dismissed the application of accused Ritu Malu in the Ram Jhula hit-and-run case, allowing the amendment request filed by the complainant. The case is now reserved for a final order.

During the hearing, the complainant’s counsel argued that the CID, now handling the investigation, can only seek the cancellation of Ritu Malu’s bail through an application filed by the Tehsil Police. Malu’s request to quash the bail cancellation application was rejected by the court.

The State requested the court to amend the records by replacing the Tehsil Police Station's name with the CID, as the Nagpur Bench of the Bombay High Court had transferred the investigation to the CID. The State argued that this amendment should be reflected in court records.

Ritu Malu’s counsel, however, contended that the CID should file a new application rather than amending the existing one, as there is no provision for such an amendment under the Criminal Procedure Code (CrPC). On the other hand, the complainant’s lawyers cited a Supreme Court ruling, which allows amendments if they do not affect the opposing party and if the nature of the case remains unchanged.

Given that the investigation was now with the CID, they have the right to request bail cancellation through the Tehsil Police’s application, according to the complainant's lawyers.

Advocate Amol Hunge represented the complainant, while Ritu Malu's legal team challenged the state's application to cancel her bail. The court will issue a final order on the matter soon.
