Kanhaiya Builders to Refund Rs 2.4 Lakh for Deficient Service
Nagpur, India- In response to a complaint filed by Deepti Matade, a resident of Tilak Nagar, the Additional Nagpur District Consumer Disputes Redressal Commission has found Kanhaiya Builders guilty of unfair trading practices and deficiency in service. The commission's President, Satish Sapre, and Member, Smita Chandekar, after reviewing the evidence, partially upheld the complaint.
The commission has ordered the builder to refund Rs 2.4 lakh to the complainant, along with 18% interest from August 21, 2010, and an additional Rs 35,000 for physical and mental harassment and legal expenses.
Matade had agreed with Kanhaiya Builders to purchase a bungalow in their Wathoda project for Rs 12.31 lakh, paying Rs 2.4 lakh by August 20, 2010, with the balance to be paid in instalments as construction progressed. However, the builder failed to start the construction and did not provide any satisfactory explanation or respond to a legal notice, prompting Matade to approach the commission.
