Woman Accused of Killing Husband in Chandrapur Seeks Bail, SC Issue Notice

Nagpur, India: The Supreme Court of India has sent a notice to the Maharashtra government about a case where a woman is accused of killing her husband in Chandrapur. The notice was issued by Justice Manoj Mishra and Justice K V Vishwanathan. The court has asked Maharashtra to respond within three weeks.  

The case happened on July 18, 2024, when Laxmi Pode had a fight with her husband, Amol Mangal Pode. The police say Amol, who was drunk, attacked Laxmi with a knife. In self-defence, Laxmi stabbed him during the struggle.  

Laxmi has been in jail since her arrest that day. She applied for bail, but both the Sessions Court and the Nagpur Bench of the Bombay High Court rejected her request. After this, she went to the Supreme Court to challenge the High Court’s decision.  

Laxmi’s lawyers said she had been a victim of domestic violence for many years. They explained that Amol often fought with her after drinking alcohol. On the night of the incident, when Amol attacked her with a knife, she acted in self-defence.  

Laxmi is facing charges under Section 103(1) of the Bharatiya Nyaya Sanhita, 2023. Her lawyers also said that the High Court was wrong to deny her bail as the details of the case should be decided during the trial. They pointed out that Laxmi has no criminal record and even informed the police about the incident.  

The Supreme Court is now waiting for Maharashtra’s reply before making any further decisions.
